These Terms and Conditions (“Terms”) govern your use of our website (the “Website”) and the vehicle scrapping services (the “Service”) offered by Vscrapit (“we,” “us,” “our”). By accessing our Website or using our Service, you agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not use our Website or Service.

1. Description of Service

VSCRAP IT provides a platform for owners of end-of-life vehicles, including cars and bikes (“Vehicle”), to request a valuation, schedule a pickup, and have their Vehicle legally scrapped in accordance with Indian regulations.

2. User Eligibility and Obligations

To use our Service, you must:

Be at least 18 years of age.
Be the legal and registered owner of the Vehicle you wish to scrap.
Provide accurate, complete, and current information about yourself and your Vehicle.
Possess all necessary legal documents required for the transfer and scrapping of the Vehicle.
Ensure that the Vehicle is free from any and all liens, loans, hypothecation, or third-party claims.

3. The Scrapping Process

Request a Quote: You can submit details of your Vehicle through our Website or by contacting us to receive a non-binding, estimated quote. This quote is based on the information you provide.
On-Site Inspection: The final price for your Vehicle will be confirmed only after a physical inspection by our authorized representative at the time of pickup. We reserve the right to adjust the initial quote based on the actual condition of the Vehicle, missing parts, and document verification.
Scheduling Pickup: Upon your acceptance of the final offer, we will schedule a mutually convenient date and time for the pickup of your Vehicle.
Documentation: You must provide the following original documents at the time of pickup for verification:
- Original Registration Certificate (RC) of the Vehicle.
- Valid government-issued photo ID of the registered owner (e.g., Aadhaar Card, PAN Card, Passport).
- Proof of Address of the registered owner.
- A signed letter of authority if the registered owner is not present at the time of pickup.
- An affidavit on stamp paper declaring that the Vehicle is free from all debts, liens, and legal disputes.
Payment: Payment will be made to you via a verifiable method (such as bank transfer, UPI, or cheque) after the successful pickup of the Vehicle and satisfactory verification of all required documents. No cash transactions will be made.

4. Transfer of Ownership and Responsibility

Upon pickup of the Vehicle and completion of all paperwork, the ownership and legal title of the Vehicle transfer to Vscrapit.
You agree that once the Vehicle has been handed over to us, it will be dismantled and scrapped. It cannot be returned under any circumstances.
You are solely responsible for removing all personal belongings from the Vehicle before pickup. Vscrapit shall not be liable for any loss or damage to personal items left in the Vehicle.
You are responsible for clearing any outstanding traffic challans, penalties, or legal cases associated with the Vehicle before initiating the scrapping process.

5. User Representations and Warranties

You represent and warrant that:

You are the sole legal owner of the Vehicle.
All information and documents provided by you are true, accurate, and not misleading.
The Vehicle is not stolen and is not involved in any ongoing insurance claims, police investigations, or legal proceedings.
You have the full right and authority to transfer the ownership of the Vehicle for scrapping.

6. Indemnification

You agree to indemnify and hold harmless Vscrapit, its employees, and its affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

Your breach of these Terms.
Any false or inaccurate information provided by you.
Any claims related to the ownership, legal status, or condition of the Vehicle prior to its pickup by us.

7. Limitation of Liability

To the fullest extent permitted by law, VSCRAP IT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of our Service. Our total liability to you for any claim arising out of these Terms or our Service will not exceed the final amount paid to you for your Vehicle.

8. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.

9. Amendments to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will notify you of any changes by posting the new Terms on our Website. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
